Chapter 1 General Article 1 (Purpose) The purpose of this Agreement is to stipulate the conditions, procedures and other related matters concerning the use of the TeenKorean site ("the site" hereinafter) which is provided by the Overseas Korean Foundation ("the Foundation" hereinafter) in accordance with the Electric and Communications Business Act ("the Act" hereinafter) and its Enforcement Ordinance. Article 2 (Definition) The following terms shall have their meanings defined in this Agreement as written below. (1) The "TeenKorean site" means the website (http://www.teenkorean.com) established by the Foundation to provide service to members of the TeenKorean site ("the members" hereinafter). (2) A "member of the site" ("a member" hereinafter) means one who is provided with service by the Foundation after logging into the site, in accordance with this Agreement. Article 3 (Effectuation and Amendment) (1) This Agreement shall take effect directly upon its public notice to a member. (2) The Foundation reserves the right to make amendments to the Agreement when due cause exists. The Foundation shall make public notice about any amendments to this Agreement on its homepage. (3) Any amendment to this Agreement shall take effect in the manner stated in the foregoing (1). Article 4 (Other Rules) Matters not stipulated in this Agreement shall follow the directives written in the Act. Chapter 2 Membership and Use of Service Article 5 (Membership) (1) Anyone who agrees to this Agreement can be a member upon the Foundation's approval of his/her application. (2) An applicant for membership shall provide his/her personal details upon the Foundation's request. (3) The Foundation will not grant approval in the case of any of the following applications: a) An applicant who is not using his/her real name b) When any false statement is found in the application or any document with false statement(s) is attached to the application c) When the application is feared to disrupt the social order or have a harmful effect upon public morals (4) All members of the site will also become members of the http://www.hanminjok.net site operated by the Foundation, using the same identification and secret access code. Article 6 (Use of Service and Restrictions) (1) A member can use the site's service all year round, provided that there may be interruptions in service due to technical or other reasons. (2) The Foundation may put restrictions on the use of service after notice is given to the members in case of each of the following. a) When the service facility should be repaired; b) When the communications provider stipulated in the Act has stopped providing the service; c) When subjected to force majeure. (3) The Foundation reserves the right to put restrictions on the service either in whole or in part in the case of a national emergency, or when the service facilities are faced with a problem. (4) The Foundation may not accept a member's request for a change in his/her identification, in case such a change is feared to cause problems in relation to the Foundation's handling of matters that concern its members. Article 7 (Addition to, or Change in, Service Contents) The Foundation reserves the right to make additions to, or changes in, the contents of service. The Foundation will notify the members of such additions or changes in the manner it judges to be most appropriate. Chapter 3 (Obligations) Article 8 (The Foundation's Obligations) (1) If possible, the Foundation shall begin providing the service from the date set by a member in his/her application. (2) The Foundation shall provide the service in a continuous and stable manner in accordance with what is stipulated in this Agreement. (3) The Foundation shall properly handle a member's request or opinion submitted through correct procedure, and shall notify the member on how the request or opinion is handled should a certain period of time be required to assess the situation. (4) The Foundation shall not divulge or distribute to a third party any personal information on a member that it has come to acquire in the course of the provision of service without the member's prior consent, unless the request originates from a government institution including the Information and Communications Ethics Committee or the police, in accordance with the Act or other relevant laws and regulations. In these aforementioned cases the Foundation shall comply with such a request. (5) The Foundation may draw up internal statistics or data as for its PR activities using the personal information of its members, within the extent that the foregoing clauses are observed. Article 9 (A Member's Obligation) (1) A member shall manage his/her identification and secret access code under his/her own responsibility. If a member is found not to have used his/her real name or to have submitted a document with false statement(s), or to have applied for a membership doubly, or to have used the information of another member including a telephone number in an unauthorized way, the offending member shall be deprived of his/her membership and be held responsible for any loss or damage that may be caused to the Foundation or its members as a result. (2) In case a member judges that his/her identification or telephone number or other personal information is being misused, he/she shall immediately inform the Foundation of the fact. (3) A member shall observe the provisions of this Agreement and relevant laws and regulations, as well as other notices or guidelines that the Foundation informs the members of from time to time. (4) A member shall act in accordance with public notices, including restrictions given or placed from time to time by the Foundation. (5) A member shall not engage in business activity using the service without the Foundation's prior consent in writing. The Foundation will not be responsible for any business activity results when carried out by a member in violation of this Agreement. The Foundation reserves the right to ask a member for compensation of loss or damage that it incurs due to business activity carried out in violation of this Agreement. (6) A member shall not transfer any of its rights or obligations under this Agreement to a third party. Nor shall he/she offer this Agreement as collateral under any circumstances. Chapter 4 (Withdrawal of Membership and Restrictions of Use) Article 10 (Withdrawal of Membership) (1) A member may withdraw his/her membership using the withdrawal menu provided on the site. (2) The Foundation will let a member applying for withdrawal know of the code that he/she must use for membership termination, via the e-mail address given by the member at the time of membership application. (3) A member can ensure that his/her withdrawal was successful by trying to log in using his/her identification and secret access code. Any log in attempted using the identification and secret access code of a member whose membership has been withdrawn is not accepted. (4) Upon withdrawal of the membership, all personal information etc submitted to the Foundation will be completely deleted from the site's records. (5) One who also wishes to withdraw his/her membership at the http://www.hanminjok.net site shall follow the same procedure for withdrawal at the aforementioned internet address. Article 11 (Restrictions on Use of Service) (1) The Foundation reserves the right to place restrictions on a member's use of the service for a certain period of time, or may force him/her to withdraw his/her membership, if he/she is engaged in one of the following acts: a) An act which has a harmful effect on public morals or disrupts the public order; b) A criminal act; c) An act to use the service to cause damage to national or public interest; d) Unauthorized use of another person's identification, secret access code, resident registration number or telephone number; e) An act that may defame, or give disadvantage to, the honor of another person or organization; f) Double registration by one and the same user with different identification data; g) An act that hampers the sound use of the service; h) An act that is in violation of the conditions set by relevant laws, regulations or by the Foundation i) An act that defames the honor of the Foundation (2) Should restrictions necessarily be placed on a member's use of the service, the Foundation will inform the member or his/her agent of its decision via e-mail or telephone, including the reason for and period of restriction. The Foundation may place to stop the service on an urgent basis. such restrictions without taking a due course for notification if it is deemed necessary (3) A member or his/her agent notified of the Foundation's decision to stop the service, as stated in the foregoing (2), may ask for the Foundation's reconsideration of this decision. (4) The Foundation will immediately resume service to a member for whom the reason for a stoppage of the service has been removed. Article 12 (Restrictions on Content of Materials Posted on Bulletin Board) The Foundation reserves the right to delete the contents of material put on the site's bulletin board etc by a member without notifying the member, if the contents have the following characteristics: a) Materials that slander, or defame the honor of, an individual or an organization; b) Materials that disturb the public order or have a harmful effect on public morals; c) Materials whose distribution constitutes a criminal act; d) Materials that infringe upon a third party's intellectual property rights or other rights; e) Materials that are in violation of relevant laws, regulations or rules set by the Foundation Chapter 5 Change in Registered Matters Article 13 (Change in Registered Matters) A member may ask for a change in his/her address, telephone number or other information that has been registered with the Foundation through e-mail or other means. Chapter 6 Provision of Information Article 14 (Provision of Information) The Foundation will provide various updates and information to the members from time to time. Additional Rules This policy will be applied from November 7, 2005. The previous policy which has been enforced since November 1, 2000 will be replaced with the new.
